Gotchii is operated by Wensday Pte Ltd ("Wensday", "we", "us", "our"), a company registered in Singapore. These Terms of Service ("Terms") govern your use of the Gotchii mobile application (the "App").

1. Acceptance of terms

By downloading, accessing, or using Gotchii, you agree to be bound by these Terms. If you do not agree, do not use the App.

2. Description of service

Gotchii is a virtual pet companion app. Your pet's wellbeing is influenced by your daily step count and screen time, tracked via Apple's HealthKit and Screen Time frameworks. Gotchii is provided for entertainment purposes and is not a fitness, medical, or health-monitoring product, and should not be relied on as one.

3. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country) to use Gotchii. By using the App you confirm you meet this requirement.

4. Accounts

Gotchii requires an account, created via a supported social login provider. You are responsible for keeping your login credentials secure and for all activity under your account.

5. Health and activity data

Gotchii reads step data from Apple HealthKit to power the pet's wellbeing mechanic. This data is used only to run the app's core feature and is not used for advertising or sold to third parties. Gotchii does not diagnose, treat, or provide medical advice, and step counts shown in-app may differ from other health apps due to how they're sampled.

6. Screen time data

Gotchii uses Apple's Screen Time / FamilyControls frameworks to reflect your device usage in the pet's wellbeing mechanic. This data stays on-device wherever Apple's frameworks allow and is used only to power the app experience, not for advertising.

7. Membership

Gotchii offers an optional paid membership that unlocks certain features and funds the app's ongoing development. Membership is billed on a recurring basis until cancelled, through your Apple ID account settings. You can cancel anytime; cancellation takes effect at the end of the current billing period. Fees already charged are non-refundable except where required by law.

8. Pet loss and re-adoption

If your Gotchii "fades" due to prolonged neglect, you may apply in-app for a new one. Approval is reviewed manually and is not guaranteed.

9. Acceptable use

You agree not to reverse-engineer, tamper with, or abuse the App, including manipulating sensor data to exploit the pet mechanic, or use the App for any unlawful purpose.

10. Intellectual property

All content, design, characters, and branding in Gotchii, including the "Gotchii" name and pet designs, are owned by Wensday Pte Ltd. You may not copy, reproduce, or redistribute App content without permission.

11. Termination

We may suspend or terminate your account if you violate these Terms. You may stop using the App and delete your account at any time.

12. Disclaimers

Gotchii is provided "as is" without warranties of any kind. We do not guarantee uninterrupted or error-free operation.

13. Limitation of liability

To the maximum extent permitted by law, Wensday Pte Ltd is not liable for any indirect, incidental, or consequential damages arising from your use of the App.

14. Governing law

These Terms are governed by the laws of Singapore, without regard to conflict-of-law principles.

15. Changes to these terms

We may update these Terms from time to time. Continued use of the App after changes take effect constitutes acceptance.
